These Terms and Conditions (“Terms”) govern the use of the website balkan-flow.com and participation in tours, activities, events and services organized by Balkan Flow (“the Company”, “we”, “us”, “our”).
By accessing this website, making a booking, submitting payment, or participating in any tour or activity, you confirm that you have read, understood and fully accepted these Terms without exception.
1. General Provisions
1.1. Balkan Flow organizes outdoor and adventure activities including, but not limited to, sea kayaking, SUP (stand-up paddleboarding), lake kayaking, canyoning, hiking, sightseeing and related one-day or multi-day tours.
1.2. All activities involve inherent risks associated with outdoor and water-based environments. Participation is entirely voluntary.
1.3. All actions taken on this website, including browsing, booking, payments and communication, are performed at the sole responsibility of the user / buyer.
2. Participant Responsibility & Health Declaration
2.1. By purchasing or participating in any activity, the participant confirms and guarantees that:
- they are in good physical and mental health;
- they have no medical conditions that would make participation unsafe;
- they are able to swim independently;
- they possess sufficient physical fitness for the chosen activity;
- they are not under the influence of alcohol, drugs or substances affecting judgment or physical ability.
2.2. The participant assumes full responsibility for evaluating their own health condition and suitability for participation.
2.3. The Company shall not be held responsible for any consequences arising from the participant’s failure to disclose medical conditions or from inaccurate health declarations.
3. Safety & Emergency Situations
3.1. All tours are conducted with an emphasis on safety, including briefings, professional guidance and appropriate equipment.
3.2. If a participant experiences health issues or physical distress during an activity, the Company will take reasonable and lawful measures, in accordance with the legislation of Montenegro, to assist the participant and return them to a location accessible for professional medical assistance.
3.3. All responsibility for health-related incidents lies entirely with the participant, including any medical costs, transportation, or related expenses.
4. Limitation of Liability
4.1. The Company shall not be liable for any injury, loss, damage, delay, accident, illness or death resulting from:
- natural conditions (weather, sea state, wildlife, terrain);
- participant negligence or misconduct;
- failure to follow guide instructions;
- third-party actions;
- force majeure events.
4.2. The Company bears no responsibility in the event the participant violates any provision of these Terms.
4.3. Under no circumstances shall the financial liability of Balkan Flow exceed the total amount paid by the participant for the specific activity.
5. Bookings, Payments & Acceptance of Terms
5.1. Any form of booking or payment -- including website payments, bank transfers, cash payments, or third-party platforms -- constitutes full acceptance of these Terms.
5.2. By completing a booking, the buyer accepts full responsibility for compliance with these Terms for themselves and for any participants included in the booking.
6. Cancellation & Refund Policy
6.1. Regular Group Activities
A refund of up to the amount of the paid deposit may be granted to an individual participant if a cancellation request is received:
- no later than 24 hours before the scheduled start of the activity,
- via email or WhatsApp message to the official company contact.
6.2. Private / Individual Activities
A refund of up to the amount of the paid deposit may be granted if a cancellation request is received:
- no later than 7 days before the scheduled start of the activity,
- via email or WhatsApp message to the official company contact.
6.3. Weather & Organizer-Dependent Cancellations
If an activity is cancelled due to weather conditions or other circumstances beyond the organizer’s control:
the deposit may be rescheduled to another date (by mutual agreement), or refunded to the participant.
7. Conduct & Compliance
7.1. Participants must follow all instructions provided by guides and staff at all times.
7.2. The Company reserves the right to exclude any participant from an activity without refund if their behavior poses a safety risk to themselves or others.
8. No Exceptions
8.1. No exceptions, modifications or waivers to these Terms are permitted under any circumstances.
9. Governing Law & Jurisdiction
9.1. These Terms are governed by the laws of Montenegro, in accordance with applicable EU regulations.
9.2. Any disputes shall be resolved under the jurisdiction of competent courts in Montenegro.
